2021 Election Procedures

Timeline:
The Business District of Camden County will accept self-nominations ONLY to fill expired terms for: one (1) Camden Small (1-50 units) and one (1) Camden Medium (51-299 units) seat.  Self- nomination forms will be available in the Camden County Clerk’s office, no less than forty-five days prior (March 3, 2021) to the election.  Eligible candidates and voters are verified with the current lodging tax collection report provided by the Camden County and Miller County Collector and updated by TCLA Staff with the assistance of the Business District Advisory Board Members.   Said self-nomination forms must be returned to the Clerk’s Office by close of business on March 15th, 2021.

The Business District of Miller County will accept self-nominations ONLY to fill an unexpired seat in the Miller Small category (1-50 lodging units).  Self-nomination forms will be available in the Miller County Clerk’s office not less than forty-five days prior (March 3, 2021) to the election. Eligible candidates and voters are verified with the current lodging tax collection report provided by the Camden County and Miller County Collector and updated by TCLA Staff with the assistance of the Business District Advisory Board Members.   Said self-nomination forms must be returned to the Clerk’s Office by close of business on March 15th, 2021.

The Business Districts will provide the self-nomination forms to the respective County Clerk’s office. 

Thirty (30) days prior to the election date, an Election Notice will be sent to all eligible voters advising them of the candidates and of the opportunity to vote at their respective County Clerk’s offices.  The deadline to vote at the County Clerk’s offices will be 4:30 p.m. or close of business on April 20th. Ballots will be provided by the Clerk’s office with space for write-in candidates. Voting will begin March 19th and run through the close of business on April 20th, 2021.

Eligible candidates and voters are verified with the current lodging tax collection report provided by the Camden County and Miller County Collector and updated by TCLA Staff with the assistance of the Business District Advisory Board Members. 

Voting Procedure: 
The Business District of Camden County and Miller County have requested each County Clerk’s Office handle the election at their respective offices. 

Ballots will be handled by the respective County Clerk staff. The County Clerk staff will verify the voter is eligible to vote in that county as a lodging entity based on their current lodging tax collection list. 

Property Managers shall be required to produce the following: 1.) A list of the properties you manage with addresses. 2). A notarized affidavit attesting to the fact that you manage the listed properties. 3.) A copy of a contract, contract addendum or authorization letter acknowledging that you, the property manager is authorized to vote on their behalf. This document must contain the name of the unit owner and the address to cross reference to the above-mentioned list.  All documents must be left with the County Clerk’s Office the day you cast your vote.

The respective County Clerks will prepare a voting summary of elections within their counties and also declare the winners for each seat.  This report/announcement will then be e-mailed to the Business District(s)’ official e-mails on the morning of April 21st for candidate notification and public dissemination.

The Tri-County Lodging Association Board of Directors had previously sought legal clarification for the voting procedures for those that manage vacation rental property for overnight rentals.  The following is an explanation of this procedure:

If a property management company manages 100 houses/condos in Camden, Miller, or Morgan County, withing the boundaries of the respective Lake of the Ozark Area Business Districts, the property manager, WITH permission from the home/condo owner, may vote in their place.  A property manager with 100 properties (Each home/condo is an individual business as the owner is technically responsible for the lodging taxes to be remitted) could potentially cast 100 votes in the Small category of the appropriate Business District.  Said property manager would be required to provide legal proof that they have this permission or have this in their management contract and produce same.  Legal counsel offered the following verbiage as an example of the home/condo owner’s permission to vote in their place:

  1. A signed statement by the property owner “I authorize ____ to vote on behalf of _____.”

  2. A verified statement by the property manager “I, _____, do hereby swear and attest under penalty of perjury, that I am authorized to vote on behalf of ______.”
